3.      WHO WILL BE ELIGIBLE FOR REGISTRATION AS AN ADVOCATE:

Advocate refers to a person who is listed under “The Bangladesh Legal Practitioners and Bar Council Order 1972 [P.O 46 of 1972]”.

 

4.      REGISTERED ADVOCATE:

All Advocates of the Supreme and lower court who are registered can provide services: Criminal Case advice, Civil Case advice, Family Counseling/Advice, Cyber Advice, Texts, Notary, Immigration advice, company registration advice etc. can provide advice or services.

 

5.      AS A USER:

Hello Advocate is a platform, not a legal service provider, where legal seekers seek lawyers by using this platform without any payment but for the service rendered from the lawyers. We are giving you advice that before taking any kinds of legal service, from the Advocate legal service related and next of legal matters about shall be made of details discussion. In this case is specially mentioned that already before taking any kinds of legal service with any Advocate, all kinds of legal fee and transaction process will be known and understood and to be taken decision, where has no consistence of (Hello Advocate App / Website Authority) and shall not be liable by any means.

 

6.      REGISTRATION CANCELLATION PROCESS:

a)      If you have provided fake / false / created bar council license number and bar Association id/membership no. 

b)      If he / she expresses inability to offer advice / legal services as an advocate to the person seeking services / advice.

c)      Complaint of the person who takes service / advice may be expelled from the Hello Advocate service at. You have done any activities contrary to the prevailing law of the country using the Hello Advocate service.

d)      Your registration authority will cancel, but you will have the opportunity to defend or reply to your email at 30 days after cancellation.

 

In this case, by the said App user Advocate of added false/wrong information purpose (Hello Advocate App and website authority) shall not be liable by any means.

 

7.      OUR LIMITATIONS:

·         Among the app user client and Advocate, case/suit previous and case/suit after operation related all kinds of expenditure and on the basis of discussion in relation of remuneration of the Advocate shall be taken with fixing. (Legal Fees/consultation fees /Remuneration may be changed as per experience of the Advocate).

·         We are (Hello Advocate) as only the third party do communicate of the App / Website user client to the Advocate. Any kinds of user client in consciously after communicate with the Advocate received from the Web / App and in the Power of Attorney (Vokalatnama) before giving power to run case/suit to the Advocate, the user advocate to his client case/suit operation related all kinds of expenditure and his remuneration related discussion shall be performed.  Among the client giving power to the Power of Attorney (Vokalatnama) and Advocate, any kinds of transaction, procedure or any kinds of problem purpose, we have (Hello Advocate App and Website) authority shall not be liable by any means.

 

8.      LEGAL DISPUTES:

In the event of a dispute between you and Hello Advocate / Black Coat, our objective is to ensure a prompt and cost-effective resolution. As such, you agree that Hello Advocate / Black Coat holds the exclusive right to resolve any claim or controversy arising out of this Agreement or our services. No alternative dispute resolution methods shall apply, and the decision provided by Hello Advocate / Black Coat will be final and binding.

 

9.      APPLICABLE LAW AND JURISDICTION:
These Terms and Conditions are governed by the laws of Bangladesh. Subject to the Arbitration clause, all disputes shall fall under the exclusive jurisdiction of the courts in Dhaka, Bangladesh.

 

10.  ARBITRATION:
All disputes arising from these Terms and Conditions shall be resolved exclusively through binding and confidential arbitration in Dhaka, Bangladesh, conducted by a legally trained arbitrator with expertise in information technology. The arbitrator’s decision will be final and binding.

 

Hello Advocate / Black Coat reserves the sole right to independently resolve any disputes and may seek legal remedies through the courts of Dhaka to protect its intellectual property and confidential information.

 

11.  PAID SERVICE POLICY:

This Paid Service Policy outlines the terms and conditions governing all paid services provided by Hello Advocate. By purchasing or subscribing to any paid service, you agree to the following terms:

A.    Service Fees:

·         All fees for paid services must be paid in advance as specified at the time of purchase.

·         Fees are non-refundable, except as outlined in our Refund Policy.

·         Registered lawyers have full right to set their consultation charge.

·         Hello Advocate / Black Coat will take 25% service charge from the income of the registered lawyers.

B.     Payment Methods:

·         Payments can be made through accepted methods specified on our platform.

·         Hello Advocate reserves the right to add or remove payment options at any time.

·         The user and the registered Advocate must follow the terms and conditions of the payment partner / SSL Commerz.

·         In case of payment refund, payment partner has the right to take service charge or penalty on the refundable amount.

C.    Service Activation:

Services will be activated upon confirmation of full payment. Delays in payment may result in service delays or cancellations.

D.    Cancellation and Termination:

Hello Advocate reserves the right to cancel or terminate any paid service at its discretion for violations of our terms, misuse of services, or non-compliance with payment terms.

E.     Refund Policy:

·         Refunds will only be issued in cases of service non-delivery or as otherwise agreed in writing.

·         No refunds will be provided for partial use of services or client-initiated cancellations.

F.     Modification of Services and Fees:

Hello Advocate reserves the right to modify the scope, features, or pricing of any paid service at any time with prior notice.

G.    Dispute Resolution:

·         Any disputes related to paid services shall be governed by our Applicable Law and Arbitration policies.

·         Hello Advocate reserves the exclusive right to resolve disputes independently as outlined in the terms of service.

H.    Compliance with Policies:

· By using paid services, you agree to comply with all applicable policies, terms, and conditions set forth by Hello Advocate.

12.  CALL THE ADVOCATE AND DISCUSS YOUR MATTER:

·         Your reply to the query will expire after 2 days, and payment will be released to the advocate who responded to your question.

·         If a user fails to meet the advocate online or call at the scheduled time or chooses not to communicate, the booking will be considered canceled. In such cases, the booking fee is non-refundable.

 

13.  PAYMENT TRANSFER TO ADVOCATE POLICY:

a)      By registering with Hello Advocate, advocates agree to a 25% platform service fee, which will be deducted from their earnings for each service rendered via Hello Advocate/Black Coat.

b)      Fees for services provided by registered advocates will be processed and paid out within the first 15 working days of the month following the service period.

c)      Payments will be issued only after deducting the applicable VAT and taxes as per regulations.

d)      If an advocate accepts a booking or consultation fee through the platform but fails to respond to the client or provide the agreed service (online or over the phone) within two working days, the corresponding fee will be deducted from the advocate’s payable amount.

e)      Advocates are required to comply with refund requests in such instances. Hello Advocate enforces strict policies against misconduct, including attempts to arrange personal meetings or sharing personal contact information with clients during consultations. If a client submits a valid complaint with evidence of such behavior, the client will be entitled to a refund. In these cases, the advocate will forfeit their consultation fees and may be permanently disqualified from using the Hello Advocate App/Website, even if payment has already been made.

 

14.  HOW WE USE THE INFORMATION, WE COLLECT:

a)      We gather this information to verify your identity, assess your prior experience in the legal sector, and ensure transparent service delivery to our clients.

b)      The information may also be utilized to enhance our products and services. Occasionally, we may send you promotional emails featuring new offerings, special deals, or other content that might interest you.

c)      Additionally, we may reach out to you periodically for market research purposes using the contact details provided.

 

15.  INTELLECTUAL PROPERTY RIGHTS:

All intellectual property rights, including copyrights, trademarks, patents, brand names, and corporate names, related to any materials or content (such as software, data, applications, text, images, music, sound, videos, graphics, logos, symbols, designs, layouts, and other visual or multimedia elements) available through the Services ("Content") are either the property of Hello Advocate or have been authorized for use under a license from the respective rights holders. The Hello Advocate / Black Coat name, logo, and bird emblem are registered trademarks and copyrights of Black Coat. Any other copyrights or trademarks featured that are not owned by or licensed to Black Coat / Hello Advocate belong to their respective owners.
